Dear Dana and Wendy,

I am sending you two letters (below) in order to better assist DLA in their investigation into the facts surrounding MILITEC-1. Please pass this message on to your superiors. Thank you.

Both of these letters (and our extensive documentation) clearly demonstrates that our NSN's were officially recognized by Congress, Military, Federal Law Enforcement and State Department Activities, Worldwide for the last ten (10) years. I was told today that DLA and OTHERS did not realize that for the last ten (10) years that all NSN's for MILITEC-1 and MILITEC-1 Grease were supposed to be canceled, (as a result of ARDEC's Faulty testing) however, "nobody was ever notified", including elements of DLA that our NSN's are canceled.

We find it interesting that other products, XXX and XXX, just to name a few, are being managed by DLA and they don't have Mil-Spec's. Have these companies NSN's been canceled? Do they have war orders that have been canceled? Do all Federal Law Enforcement Agencies use their products. The answer to all three questions is no.

Now after ten (10) years DLA is attempting to deny our Combat Forces (That Are at War) a critical technology that will protect their most important piece of equipment, their small arm. Please pay careful attention to this message that just arrived from Kuwait:

Ok Brad time to tell this guy that the reason the 31 yr old Navy Seal who fell out of a helicopter about 7 months ago, in Afghanistan, died in a firefight cause he was using CLP and both his weapons jammed. I got that from a reliable source in the 3BCT of the 3 ID and that is one reason they switched to MILITEC> Have this dumb SOB get hold of any of the 3ID BCT commanders and ask about MILITEC

WE need to go to congress again,l and the DA IG and if you wish I will e mail Gen Kern.

Here are additional facts to consider: Mr. LePera removed us from AMDF or Army Log. His actions (at this time) were not related to canceling our NSN's. Mr. Lepera (Former Head of Lube and Fuels) in 1993 initiated the cancellation of our NSN's. However, legal intervention prevented his hostile actions to continue.

Dear General Andrews:

I have received two complaints from MILITEC, Incorporated that Mr. Maurice E. Lepera, of the Mobility Technology Center-FT Belvoir, has removed their product for weapons and machine shop application from the Army Master Data File (AMDF) or Army log.

Twice, I had asked TACOM for the facts and TACOM responded that was not true and that the Navy was responsible for the products removal. The Navy's response was Mr. Lepera was responsible. Enclosed is a memorandum from Mr. Printy (Chief, Logistics Data Management Center) who is responsible for the AMDF, and who also documents Mr. Lepera was responsible. Could you please investigate and advise me on this matter.

Dear Admiral Lippert:

I have been apprised of an effort by the Navy Sea Systems Command to remove the NSN's of a synthetic metal conditioner that is an additive lubrication product called MILITEC-1. I'm told that it has been used by the Navy, the Treasury Department and the Justice Department since 1989. The Secret Service and the Drug Enforcement Agency currently mandate the use of MILITEC-1. I don't know the motives, but it seems premature and without the benefit of a complete evaluation.

I am also aware that Naval Sea Systems Command held a Lubricant Technology Conference in April and invited various military organizations and representatives from oil companies to discuss lubricants with an emphasis on additives. It is interesting to note that no representatives from any of the after-market additive manufacturers were included in the conference. This raises doubts about the conclusions and makes them suspect that they were reached by a fair and impartial review.

It would seem, in my opinion, that a formal review, including all government agencies and parties with an interest, should be completed prior to any removal of the NSN's of this product. I would appreciate your looking into this issue and providing me a report with your findings. I appreciate your attention to this matter.

Sincerely,

Member of Congress

I believe this additional documentation will allow DLA to promptly support our Forces, in this time of war.

If DLA's actions continue, our Beloved Forces will be put at additional risk. I have advised the DoD IG of this same problem for the past year. As a result, A Navy Seal was Killed and others severely wounded. These are facts that I strongly recommend you consider, prior to any further delays, which are putting our Forces in additional danger.

Thanks again and God Bless America and our Forces.

Dear Wendy and Dana,

Russ Logan just informed me of his call from DLA. Can you please share this information with the Gentleman that spoke to Russ Logan this morning?

I have three questions:

1. Is DLA aware of the June 29, 1995 letter from the Under Secretary of Defense? This letter is pasted below.

07/13/95 THU 16:46 FAX 202 225 1108 HON GREG LAUGHLIN 002

Office Of The Under Secretary Of Defense, Federal Government
(L/MDM)

Honorable Greg Laughlin

Washington, DC 20515-4314

Dear Congressman Laughlin:

Thank you for your letter of May 18, 1995, to Secretary Perry concerning MILITEC-l. I am pleased to inform you that the Defense Logistics Agency is in the process of establishing two new National Stock Numbers for the one ounce and four ounce containers of MILITEC-l, for weapons grade and machine shop applications respectively. These two products will be made available to all activities within the Federal Government. The Defense Logistics Agency will advise MILITEC of the National Stock Number assignments when they occur.

Sincerely,

Is DLA aware of the 18 September, 1995 letter from DLA which was a result of Congressional action? The letter is pasted below.

Dear Mr. Giordani:

The Defense Logistics Agency, through the Defense General Supply Center (DGSC), has established three new National Stock Numbers (NSNs) in Federal Supply Class (FSC) 9150 for MILITEC-1. These are now available to the Military Services for weapons and machine shop applications.

Further, for other Department of Defense activities, other Federal Government agencies, and state and local law enforcement agencies, DGSC will offer the above-mentioned items, as well as the larger sizes of MILITEC-1, listed in FSC 6850. The following is a list of NSNs for your products:

And finally, did DLA read the letter from Congress dated March 17, 1995. This letter is pasted below. Thank you for explaining to us why these three (3) letters are considered null and void by DLA. Best Regards, Brad P. Giordani www.militec.com

March 17, 1995

The Honorable William J. Perry
Secretary of Defense
Department of Defense
Washington, D.C. 20310

Dear Mr. Secretary:

This letter addresses an ongoing situation in your department regarding the interruption of delivery to the services of a metal conditioner called MILITEC-1. We are familiar with the product and its proven effectiveness in various applications. We are concerned that, despite the efforts of Congress to help resolve a problem with the continued delivery of this product within the DOD community, the issue is still unsettled.

It appears to us that the delay in resolving this situation is denying our forces the use of the same product that other federal agencies - including the United States Secret Service and the Drug Enforcement Administration - specify for use. We cannot understand why the money-saving and even potential life-saving benefits of MILITEC-1 are currently not available to our military personnel, when other agencies put this product to good use.

We understand that a reasonable solution for a continued delivery of MILITEC-1 was recently agreed upon between Congress and representatives of the Naval Sea System Command and the Defense Logistics Agency - only to be reneged upon by NAVSEA last month. This agreement is in the best interests of all parties and should go forward :

the Defense Department will approve continued listings of MILITEC-1 in the Defense Supply Catalogue for use in DOD as a weapons lubricant and for machine shop applications, and will process all requisitions and orders from DOD and non-DOD agencies.

Secretary of Defense, Page 2

Further, this solution is consistent with the letter and spirit of your June 29, 1994, memorandum on procurement, and with the recent action of Congress in passing the Federal Acquisition Streamlining Act. In short, why should the Armed Services be prevented from using a product used effectively by the Secret Service and mandated by the DEA ? If MILITEC-1 is available to protect the President, should it not be made available to protect our Soldiers, Sailors and Airmen ?

We strongly urge you to direct the implementation of the accord originally negotiated by NAVSEA and DLA and so inform the Committee on National Security.

Sincerely,

Can you explain to us why these three (3) documents do not apply to DLA ?

Hey Brad
Once again, you want me to get into this??? I will write Gen Kern personally if I must and attest to MILITEC> Challenge him to ask personally the three brigade commanders in the 3ID. 1st Brigade Col. Grimsley--a real fanatic about MILITEC, 2d Brigade-Col. Perkins, big fan, 3d Brigade-Col Allyn--super big fan. Go ahead. tell the 3 brigade commanders as they cross the border they will not have MILITEC. This particular act is aiding and abedding the enemy.

The strength to MILITEC is the distributorship, but it wont work in the states, so we really need the NSN business as you well know.

We have been dodging SCUD missiles all day the Patriots have knocked them out of the sky--not just altering course, but detonating in the air. No chemicals yet, although, we have already done numerous MOPP drills already.

Whatever I need to do, just ask. friend bob

Dear Wendy and Dana,

I was informed by, Russ Logan, that you were checking your office records to better understand MILITEC-1 and learn why we are gaining so much popularity in DLA and with our Forces in Kuwait and Afghanistan. I also understand, that you and/or others (internal to your office) acted prematurely against Militec, Inc. by proposing to cancel, or previously canceled, our Congressionally Mandated NSN’s that were first issued by DLA in 1993, and by canceling all orders that are required to support of our Combat Forces and Homeland Security Department initial operations.

Two days ago we were told to prepare for more orders (which we knew) and the very same day we were told "the approval came from the top" (which we also knew). Then, the next morning someone finds an internal document (s) that is years old, and all of a sudden, all orders destined to our Combat Forces are canceled. Common sense would suggest that one may want to contact us first, to see if there is any information that contradicts or supercedes your "very old and incomplete records". Advising our Forces that their orders are canceled and no additional orders will be filled, without giving us an opportunity to respond to these half-truths, is not fair practice. Furthermore, delaying this critical technology to our Forces may be putting them at additional risk. Every conflict since desert storm, rush shipments of MILITEC-1 have been ordered by our forces in order for their weapons to operate, without jamming, in helicopter missions and in blowing sand and dust storms. This is especially critical for the Forces that carry a small arm for protection and are subject to environmental extremes.

As you know, these pending orders from Kuwait have Division Backing. Furthermore, we have received and shipped several other Military orders to Kuwait with Division Backing that did not require DLA or AMC approval. During the Kosovo conflict, DLA ordered several hundred cases of MILITEC-1 with no problems and subsequent orders, as well, with no problems. This is a contradiction to your current position.

Here is another contradiction; Military Personnel at all levels can order MILITEC-1 using their impact cards, or issuing a purchase order, however, they are not allowed to order MILITEC-1 from DLA.

I understand you cancelled an order that appeared to be for our New Homeland Security Department for 120 one-gallon containers of MILITEC-1. As you must know from my previous email and your preliminary investigation that all Federal Agencies that make up Homeland Security are long time customers of Militec, Inc. I find it hard to believe that your department would, or even could, permanently cancel an order that the Secret Service or Border Patrol issued to your department for MILITEC-1, on an emergency basis or not.

Please, also be advised, we have already shipped over Twenty-Five Thousand Dollars Worth of MILITEC-1 to our contract packager for the DLA orders. This does not include all of the other costs associated with these orders that we are liable for. We also got credit terms for these orders and these receivables are vital to our health.

As I stated in my previous email of March 19, (below) we can promptly work this matter out once you have all the available data.

I can be in your office this Friday. Please email me and let me know when we can speak, or I will call you in the morning.

Thanks again for your help.

Dear Ms. Spiers,

I was just briefed by, Russ Logan, who spoke with Wendy a short while ago concerning DLA's proposed cancellation of ALL MILITEC-1 orders and NSN's.

I must respectfully disagree with the conclusions that were derived from DLA's investigation into the facts surrounding MILITEC-1.

Attached, is a letter we received from DLA dated 18 September 1995.

We also received a letter from The Under Secretary of Defense dated June 29, 1995. Furthermore, this letter is consistent with the letter from Congress dated March 17, 1995 that was signed by 19 members. Both of these letters will be faxed to you upon request.

We have NEVER been notified about any proposed or cancellation of our NSN's. As DLA knows, MILITEC-1 is approved by all Federal Law Enforcement Agencies and these and other Agencies, including the Military have been ordering MILITEC-1 using our NSN's for years. If what DLA is now saying is true, then Federal Agencies and the Military have been ordering MILITEC-1, against official regulations for years.

This was a SHOCK, to learn that all of our orders and our lawfully issued NSN's had been cancelled or are in the process of cancelation.

If DLA's position is not reversed immediately, our small company will be severely damaged.

Please double check your documentation and let me know if you want the other two letters faxed over to you and Wendy.

Please copy, Wendy, on this message and we are available for immediate conference.

I am currently in California and will be looking into a trip into town if this matter is not resolved promptly.

I am confident, we can work this out, once you have all of the available facts.

My direct number is, 909-737-9550 and Cell 909-560-0882.

And finally, please review our Military Document section @ www.militec.com and you will find the two other letters (and more) that I previously cited.

I'm writing to you because I don't want to tell you this over the phone: This PR has been cancelled. I just got the notice this morning from Wendy Johnson. I'm so sorry! I don't know what happened!
