Dear Wendy and Dana,

I was informed by, Russ Logan, that you were checking your office records to better understand MILITEC-1 and learn why we are gaining so much popularity in DLA and with our Forces in Kuwait and Afghanistan. I also understand, that you and/or others (internal to your office) acted prematurely against Militec, Inc. by proposing to cancel, or previously canceled, our Congressionally Mandated NSN’s that were first issued by DLA in 1993, and by canceling all orders that are required to support of our Combat Forces and Homeland Security Department initial operations.

Two days ago we were told to prepare for more orders (which we knew) and the very same day we were told "the approval came from the top" (which we also knew). Then, the next morning someone finds an internal document (s) that is years old, and all of a sudden, all orders destined to our Combat Forces are canceled. Common sense would suggest that one may want to contact us first, to see if there is any information that contradicts or supercedes your "very old and incomplete records". Advising our Forces that their orders are canceled and no additional orders will be filled, without giving us an opportunity to respond to these half-truths, is not fair practice. Furthermore, delaying this critical technology to our Forces may be putting them at additional risk. Every conflict since desert storm, rush shipments of MILITEC-1 have been ordered by our forces in order for their weapons to operate, without jamming, in helicopter missions and in blowing sand and dust storms. This is especially critical for the Forces that carry a small arm for protection and are subject to environmental extremes.

As you know, these pending orders from Kuwait have Division Backing. Furthermore, we have received and shipped several other Military orders to Kuwait with Division Backing that did not require DLA or AMC approval. During the Kosovo conflict, DLA ordered several hundred cases of MILITEC-1 with no problems and subsequent orders, as well, with no problems. This is a contradiction to your current position.

Here is another contradiction; Military Personnel at all levels can order MILITEC-1 using their impact cards, or issuing a purchase order, however, they are not allowed to order MILITEC-1 from DLA.

I understand you cancelled an order that appeared to be for our New Homeland Security Department for 120 one-gallon containers of MILITEC-1. As you must know from my previous email and your preliminary investigation that all Federal Agencies that make up Homeland Security are long time customers of Militec, Inc. I find it hard to believe that your department would, or even could, permanently cancel an order that the Secret Service or Border Patrol issued to your department for MILITEC-1, on an emergency basis or not.

Please, also be advised, we have already shipped over Twenty-Five Thousand Dollars Worth of MILITEC-1 to our contract packager for the DLA orders. This does not include all of the other costs associated with these orders that we are liable for. We also got credit terms for these orders and these receivables are vital to our health.

As I stated in my previous email of March 19, (below) we can promptly work this matter out once you have all the available data.

Dear Ms. Spiers,

I was just briefed by, Russ Logan, who spoke with Wendy a short while ago concerning DLA's proposed cancellation of ALL MILITEC-1 orders and NSN's.

I must respectfully disagree with the conclusions that were derived from DLA's investigation into the facts surrounding MILITEC-1.

Attached, is a letter we received from DLA dated 18 September 1995.

We also received a letter from The Under Secretary of Defense dated June 29, 1995. Furthermore, this letter is consistent with the letter from Congress dated March 17, 1995 that was signed by 19 members. Both of these letters will be faxed to you upon request.

We have NEVER been notified about any proposed or cancellation of our NSN's. As DLA knows, MILITEC-1 is approved by all Federal Law Enforcement Agencies and these and other Agencies, including the Military have been ordering MILITEC-1 using our NSN's for years. If what DLA is now saying is true, then Federal Agencies and the Military have been ordering MILITEC-1, against official regulations for years.

This was a SHOCK, to learn that all of our orders and our lawfully issued NSN's had been cancelled or are in the process of cancelation.

If DLA's position is not reversed immediately, our small company will be severely damaged.

Please double check your documentation and let me know if you want the other two letters faxed over to you and Wendy.

Please copy, Wendy, on this message and we are available for immediate conference.

I am currently in California and will be looking into a trip into town if this matter is not resolved promptly.

I am confident, we can work this out, once you have all of the available facts.

November 26, 2003

On the 18th of March, Defense Supply Center Richmond (DSCR), increased their orders for MILITEC-1.

On the 19th of March, all war orders were cancelled without notifying the Commanders in theater.

Picatinny Arsenal directed DSCR to cancel all war orders and block our National Stock Numbers (NSN'S) which prevented our troops from ordering MILITEC-1.
