Dear Mr. Giordani,

When last I spoke to DLA, messages were being sent to the POCs for the recent cancelled requisitions informing them of the 60 day window of opportunity and asking them if they still wanted their requisition filled.

I have a call into DLA asking what kind of feedback they have received and am awaiting their reply.

I'm not sure what number Russ has been calling because I have not received any messages. My contact information is below.

COL Padgett is out of the office until the end of May.

A formal letter of response to your 4 April letter to MG Thompson is working it's way through the chain back to you. If, after you receive this letter, you wish to arrange a visit we can discuss it at that time.

Thanks,

Kevin

Dear Mr. Hayes,

We were sincerely hoping to hear from you by now.

Have the orders that were cancelled by Ernest Jeniolionis @ DLA been located?

Russ Logan has been leaving messages for 3 days without a reply from anyone in your department.

Please let us know when we can meet with you and Colonel Padgett next week. We will also be visiting DLA.

Thank you,

Dear Mr. Hayes,

It is a pleasure to finally make your acquaintance.

I was just informed (and congratulations) that you are the POC for interface with DLA for releasing delinquent war orders? Furthermore, ARDEC will be allowing the use of MILITEC-1 in Iraq and Afghanistan, Is this correct?

I've attached, Mr. Jeniolionis, emails for your reference, including evidence citing the recent death and manning of our troops that are required to use MilSpec CLP lubricants. Furthermore, Federal Law Enforcement Agents will welcome calls (they were recently given a heads up) regarding the efficacy of MILITEC-1.

Please let me know if more evidence is required for our war orders to be released by DLA ? and is, MILITEC-1 authorized for use in Iraq and Afghanistan by our Forces?

We sincerely appreciate your help in establishing the working facts.

Very Respectfully,

Brad P. Giordani

Dear Mr. Jeniolionis,

Below are additional facts surrounding the failures of CLP MilSpec Lubricants.

I hope you consider this additional evidence cited by the recently released POW's.

Dear Mr. Jeniolionis,

April 20, 2003

It appears, we did not properly address your "sixth" point. This and other information was previously sent to Dana. I pasted your sixth point below in blue for all of our convenience:
Sixth, we have received no complaints on the CLP and I requested Mr. Russ Logan provide me any documentation, test results, POCs, etc. regarding the failures and to date I have received no such information.

Below, is a brief list of federal references and weapons manufacturers that advise against using CLP. These Federal Agencies and Weapons Manufacturers have "Failure Evidence on CLP" that you are seeking. Please contact the POC's directly (government to government) and the Secret Service and FBI would (I'm sure, because we will advise them) be more than willing to give you something for the record to support your continuing investigations into the facts.

1. FBI Training Academy

2. U.S. Postal Inspectors

3. U.S. Department of State

4. U.S. Department of Justice

5. U.S. Coast Guard,

6. U.S. Secret Service

7. Naval Criminal Investigative Services

In addition to the above Federal Contacts,

A. Beretta, Benelli, Barrett, Sig and other weapon manufacturers recommend MILITEC-1 and advise against using CLP type lubricants. Since Beretta is the prime contractor for the M-9, MILITEC-1 should have been approved by the Army a long time ago. Both Maryland and Pennsylvania State Police Forces adopted MILITEC-1 over ten years ago because of Beretta's recommendations. These State Police POC's have already been sent to Dana and General Thompson.

B. Sig Saur advised DCIS to use MILITEC-1 . When DCIS submitted their first order to us, they wrote a note on their order stating that fact. Defense Criminal's number is (703) 604-8430, ATTN: Special Agent Larry Leonard. We have more Federal Credentials, however, I think you are beginning to realize the only people that still use MilSpec CLP Lubricants are in the minority and shrinking everyday.

C. Please visit our site @ www.militec.com to read the detailed emails from Kuwait regarding the Death and Manning of U.S. Personal that had malfunctions using MilSpec CLP and other critical data in our Military Document Section.

And finally, the recent release of American POW's told how they were unable to return enemy fire because their CLP treated M-16's and other small arms Jammed. Please recall, wet oil on weapons will attract sand and silt.

Unfortunately, these actions have put us (again) in a position to defend ourselves, while "everyone in this process" is wasting valuable time debating the pro and cons, on, (a) the only weapons lubricant used exclusively to protect our Commander in Chief, (b) used in every war since desert storm, (c) MILITEC-1 is the choice of weapons lubricants by U.S. Federal Agencies and over 25 current Military Activities World Wide.

Our small company is in desperate financial conditions due to your premature actions against us.

Can you please help us?

Thank you

Dear Mr. Jeniolionis,

I am still trying to understand why you (The Team Leader) cancelled our Iraqi bound war orders, while at the same time, advising us to work through Colonel Padgett’s office. So my question is this, why did you cancel orders that Colonel Padgett may have wanted released?

In 1993 when Maurice Le Pera attempted to cancel our NSN’s, your old Boss, Hal Halverson, allowed us over a year to counter untruths, prior to taking any action to help Le Pera cancel our NSN’s. Mr. Halverson did this because he knew there were no grounds for Maurice’s hostile actions. In September 1995 additional NSN’s were issued by DLA. So my question is this, since we received the below message from DLA that our orders were in jeopardy on March 19th,

Hi Russ,

I'm writing to you because I don't want to tell you this over the phone: This PR has been cancelled. I just got the notice this morning from Wendy Johnson. I'm so sorry! I don't know what happened! I talked to my supervisor about this situation a few minutes ago. She told me to call you, and I tried once, but now I've chickened out! Anyway, I really don't know what happened, but if you give Wendy a call at 804-279-5417, maybe she will be able to explain it to you.

Why did you act so aggressively, (and without informing anyone) on your decision to cancel our war orders, while there was continuing dialog with DLA and Colonel Padgett’s office?

We continue to hope the system can correct itself, however, the past 30 days paints a pretty good picture of events that leads me to believe, that history will repeat itself at DLA.

I am still hopeful by Monday we can have this issue resolved.

Thank you,

Brad P. Giordani

Dear Mr. Jeniolionis,

Thank you for your message.

I agree lets set the record strait:

1. We are talking about a weapons lubricant, not an oil additive for Tank Engines, correct? Can you please not bring up a subject that has no bearing on this issue? Thank you.

2. MILITEC-1 is available to all Military Services for weapons and machine shop applications. Please re-read the entire record. Duncan Hunter is on the second signature line of the Congressional letter. Also, please read the letter we received from DLA as a result of this Congressional action. Please let me know if Congress and DLA acted within their authority when MILITEC-1 was granted additional NSN's? This appears to be the area of contention, weather or not Congress had the authority to instruct the SecDef and DLA to issue additional stock numbers. Please clarify this for me once you have properly read the record. Thank you.

3. If the orders and NSN's were not blocked by you, who's authority caused war orders to be cancelled? Was the justification DLA’s ten year old mistake? If not, what? Please advise on this question too. Thank you.

4. Thank you for acknowledging the "alert" issue. Folks can interpret this anyway they want to. You were personally involved with trying to cancel our NSN’s in 1993. You must recall this don’t you? Then you must recall our victory, right? Of course you do. This is why "Your" recent position makes no sense.

5. Please read the local or national newspapers and talk to the Troops about the problems with CLP. I have previously furnished DLA with all of this requested information through Dana Spiers and requested that my emails be delivered to her superiors. Did you receive the emails? or would you like me to send the DLA folder that is filled with information that you apparently haven't read? Please advise on this as well. Thank you.

I can’t imagine who would go out of their way to cancel war orders that our Forces need to protect themselves. I would like DLA to explain to the families of the 507th how come their weapons jammed and were unable to return fire. HERE IS YOUR PROOF ON CLP FAILING. I will post your answer or lack hereof ON OUR NEW SITE @ www.defenselogisticsagency.com and www.dla-1.com and our main site @ www.militec.com . Now the truth will come out.

We must speak for the ones that were silenced and try with all our might to protect certain forces that are still in danger.

I hope DLA will do what’s right and stop playing politics at the expense of our Troops.

All,

Let's get the record straight.

First, ALL ORDERS were Not cancelled by my authority.

Second, the cancellation was NOT arbitrary.

Third, since the product was not approved by the Services, all NSNs were blocked for DoD requisitions. That is how and why we have been buying Militec-1 for all these years.

Forth, the same Procedures and Policies Guide for Evaluating Aftermarket Automotive Fuel and Lubricant Additives is in effect today that was in effect when the original Militec-1 NSNs were established. This Procedures and Policies Guide applies to ALL additives companies including Militec. To date, Militec has never completed the required test and has never been approved by the Army for use as an additive.

Fifth, the "alert" was NOT from "certain ARDEC personal", but was the result of an innocent question by an Item Manager here at DSCR.

Sixth, we have received no complaints on the CLP and I requested Mr. Russ Logan provide me any documentation, test results, POCs, etc. regarding the failures and to date I have received no such information.

Seventh, I concur that Brad should know, speak and write the truth.

Eight, for the record, I am a member of a team and I did nothing alone.

Russ just spoke to Ernest Jeniolionis at DLA. Ernest, informed Russ, ALL ORDERS were cancelled by his authority and he has no means of re-contacting the Troops that ordered MILITEC-1 and was "not required" to notify the Troops prior to his arbitrary cancellation of our war orders. Please recall, DLA's recent justification for canceling lawfully issued war orders was based on DLA's recently admitted "Ten Year Old Mistake" What I find most troublesome about DLA's recent behavior; they have been ordering MILITEC-1 from Militec, Inc. for the past ten years. Can you please explain to me how DLA can order MILITEC-1 for the past ten years without a single problem, then when the war breaks out ten years later, they cancel (26 orders and counting) all orders because of a "Ten Year Old Mistake" Please. Mr. Maurice LePera, head of Army fuel and lubes for the past 35 years, started this pattern of unethical behavior that continues to this day. There has been several IG investigations in to Le Pera's activities. We were recently informed that Le Pera is involved with the ZMAX engine additive Company. This company was recently fined over a million dollars by the FTC for fraudulent advertising. He has also been consulting for our Military.

I wonder if DLA alerted certain ARDEC personal about our flood of "War Orders" or was it certain ARDEC personal that alerted DLA to cancel our "War Orders ?" One does not just discover, "by accident", a ten year old mistake. The same people that caused our recent war orders to be cancelled, are the same people that tried to cancel our NSN's eight years ago. Ernest, is keenly aware of these ten year old historical facts.

We were told that our war orders would not be cancelled by all parties concerned. Not only were our war orders cancelled, DLA does not have the ability to investigate who they cancelled. DLA's position has put additional forces in harms way. The recent capture of Americans in Iraq was do, in large part, to their weapons jamming. NONE OF THEIR WEAPONS COULD RETURN FIRE WITH CLP LUBRICANTS. I will repeat myself, you cannot carry a wet CLP treated firearm in the desert. The Military firearms will jam and our forces will be injured and killed if the use of CLP continues.

If this matter is not cleared up promptly, The Folks at DLA, will be, "The Headline" on our Homepage. I promise you and them, I WILL PRINT THE TRUTH and NOTHING BUT THE TRUTH. Thank God for emails!!

The safety of our Forces are more important than protecting career bureaucrats. Furthermore, Ernest Jeniolionis will have to explain why, he alone, decided to cancel a product that our forces ordered and require, to help save their lives. SHAME ON YOU Ernest! The Capture of our Troops may have been prevented if their weapons were able to return fire.

Sir,
We have been informed that units operating within Southwest Asia are attempting to requisition MILITEC-1 for small arms lubrication purposes. Although this product has not been approved for Army use, the current wartime status of operations dictates unconventional action. We request the block on small arms related requisitions of MILITEC NSNs be removed for 60 days. This is an interim allowance and this change does not signify that it is approved for general Army usage. Our action officer is Mr. K Hayes, AMSTA-AR-CCL, DSN 880-7036. Also request that his office be provided copies of filled requisitions for a planned post-mortem.
