MEMORANDUM FOR THE RECORD

SUBJ: AMC Draft Memorandum

The Draft Memorandum from USAMC Logistics Support Activity, Redstone Arsenal, Alabama, contains several glaring inaccuracies. Some statements are untrue; others lead the reader to infer an untruth.

Paragraph 2.: "DSCR assigned National Stock Numbers to...Militec...based on Militec-marketing information." [not true]

In fact, then-DGSC requested a list of government purchasers of MILITEC-1. Militec provided that information in a letter (attached) dated July 22, 1993. DGSC then assigned NSNs to Militec products based on verified use by several federal government agencies.

Paragraph 2.: " [Militec] products did not pass the tests conducted by... TACOM to determine their use as an automotive additive." [not accurate]

In fact, Militec products never underwent those tests. The company has been on record that those tests could not measure a metal conditioner (which MILITEC-1 is), and would only measure conformance, not performance, as MILITEC-1 is designed to provide. The company would not pay to conduct tests not designed to demonstrate the performance of its MILITEC-1. DASA (Procurement), Dr. Oscar, suggested that TACOM conduct performance testing of MILITEC-l last fall, but no action has been taken to date. Militec submitted results of tests performed by several government agencies, including military, but those tests were not considered.

Paragraph 2.: "As a result of these tests... Army agreed to blocking the issue of these items..." [not true]

Those TACOM tests were not conducted.
