Dear Mr. Giordani:

The U.S. Army Materiel Command Inspector General has concluded research into your request for assistance. In your letter dated February 1,1994, you asked that we determine if Mr. Maurice LaPera improperly used his position to dispute the content of your radio advertisement, and if it is appropriate for him to write or talk with anyone else relating to this matter.

Army Regulation 70-12, Fuels and Lubricants Standardization Policy, governs aftermarket additives. It requires the producer to provide technical data, using standardized testing procedures which show the absence of harmful side effects and demonstrate a measurable benefit.

To date, the appropriate tests have not been submitted to the Fuels and Lubricants Laboratory, and the Laboratory has not approved Militec-1 for military use.

Our inquiry revealed that Mr. LaPera is Chief of the Fuels and Lubricants Laboratory at Fort Belvoir, Virginia. This is the Department of Defense Executive Agency responsible for approving aftermarket additives for military use. The U.S. Army Materiel Comand Legal Office concluded that, as Chief of the Laboratory, his contact with the radio station in reference to your advertisement did not violate any regulation or statute.
